Answer

The interpretation and application of the policies contained in the Northern Area Plan 2016 is a matter for Causeway Coast and Glens Borough Council as the local planning authority. Following the approval of a planning application, any conditions attached to that permission, and any local development plan policies that guided the decision, can then be enforced if a developer fails to comply with their permission.

There are a wide range of powers and penalties in the Planning Act (Northen Ireland) 2011 available to councils enabling them to take enforcement action, where they consider it expedient to do so, having regard to the provisions of the local development plan and to any other material considerations. Whether to take enforcement action is matter for the council, as the local planning authority, to decide.
